Personal Independence Payment (15 June 2018)

Question Asked

To ask the Secretary of State for Work and Pensions, pursuant to her Written Statement of 15 June 2018, on personal independence payments, HCWS767, what methodology she used to determine that around 1000 claimants will be affected.

Answer

The methodology takes all claimants in scope. This includes those who received a decision or were in receipt of PIP during the period 28 November 2016 (the date of the Upper Tribunal decision in LB) to 16 March 2017 (when the amendment to activity 3 made in the March 2017 amending regulations came into force). Of these, it identifies those considered to be most likely to be affected by the judgment, which includes claimants currently assessed as needing support to manage medication or monitor a health condition, and with a main disabling condition considered most likely to be affected. It then applies an estimated change in descriptor to a proportion of these cases to reflect a possible increase in award due to applying the judgment. Finally, for those who see a change in their activity 3 descriptor, the number seeing an increase in their PIP daily living award is calculated.
