Question Asked

To ask the Secretary of State for Health, how much NHS England paid to cover clinical negligence claims, excluding legal costs, in (a) cash and (b) real terms in each year since 2009-10.

Answer

The NHS Litigation Authority (NHS LA) indemnifies National Health Service organisations in England and many independent sector providers of NHS care against claims.

The NHS LA handles clinical negligence claims on behalf of its members under the Clinical Negligence Scheme for Trusts (CNST). Currently, all NHS trusts in England are members of the CNST, along with 74 private providers.
