EUROPEAN COURT RULING ON SPANISH FISHING VESSELS (7 March 1996)

Motion Details

That this House deplores the ruling of the European Court that grants to Spanish fishermen the right to sue the British Government for compensation arising from the implementation of the Merchant Shipping Act 1988; further deplores the damage done to the British fishing industry by this further undermining of national quotas; welcomes the intention of Her Majesty's Government to seek treaty changes at the forthcoming Inter-Governmental Conference; but specifically calls upon Her Majesty's Government to introduce as a matter of urgency, legislation that, notwithstanding the European Communities Act 1972, reverses the effect of this judgement.
